Privacy policy

How we process your data on this website, under the Brazilian General Data Protection Law (LGPD).

This website, talissacaldonazo.com, belongs to Dra. Talissa Caldonazo, a Family and Succession lawyer and partner at Caldonazo Advocacia. This policy explains, in plain language, which personal data we process when you visit the site or contact us, what we use that data for, who it is shared with, how long it is kept and how you can exercise your rights, under the Brazilian General Data Protection Law (Law 13.709/2018).

This English version is a translation of the policy in Portuguese. If there is any difference between them, the Portuguese version prevails.

Who looks after your data

Controller: Caldonazo Advocacia, a law firm, CNPJ 41.239.239/0001-04, headquartered in Campinas, São Paulo, Brazil.

The Family and Succession area is led by Dra. Talissa Caldonazo, OAB/SP 438.507.

Data protection officer: João Victor Santos Caldonazo, dados@caldonazo.com. This is the person to write to for any request about your data.

What data we process and why

  • When you browse the site: IP address, date and time of access, browser type and pages visited. These are technical server records, used to keep the site running and secure.
  • Access statistics: how many people visit each page, from which region and by which path they arrived, always in aggregate, without identifying you. They are collected only if you authorize it in the cookie notice.
  • Advertising measurement: when you arrive at the site through a Google ad, we record whether there was contact through WhatsApp after the click, to know whether the ad works. This is done only if you authorize it in the cookie notice.
  • When you contact us by WhatsApp, e-mail or the contact form: name, phone number, e-mail and whatever you write. They are used to reply and to schedule the consultation. In the first contact, you do not need to send documents or details of the case; that is left for the consultation. In the form, the date, time and IP address of the submission are also recorded.
  • Fortnightly newsletter: if you tick the box "I want to receive institutional updates by e-mail" in the form (the form is in Portuguese) or ask the team, your name and e-mail are added to the firm's newsletter list, together with the date and the way you asked. The firm's clients may also receive it. Every message includes a link to unsubscribe.
  • Sensitive and family data: in divorce, custody, child support, parental alienation and inheritance matters, information about your family life, health or assets, and those of your relatives, may be needed. It is processed only to analyze and defend your rights, with restricted access and under professional secrecy.

The data of those who become clients is also governed by the legal services contract and by the professional secrecy of the legal profession.

Why we may process this data

  • Site access records: compliance with a legal obligation. The Brazilian Civil Rights Framework for the Internet (Marco Civil da Internet) requires these records to be kept.
  • Access statistics and advertising measurement: your consent, given in the cookie notice.
  • Contact and scheduling: preliminary procedures related to a contract, at your request.
  • Newsletter: your consent, when you ask to receive it; for clients, the firm's legitimate interest in keeping them informed, always with one-click unsubscribe.
  • Record of the form submission (date, time and IP): necessary for the firm to prove the contact request.
  • Sensitive and family data necessary for the case: regular exercise of rights, including in a contract and in judicial or administrative proceedings.

When the legal basis is consent, you may withdraw it at any time, free of charge. Withdrawal does not affect what was done before it.

Who the data is shared with

We do not sell, rent or transfer your data for third-party marketing purposes.

For the site and our service to work, some providers process data on behalf of the firm and follow its instructions:

  • Hostinger: hosting of the site, of the contact form and of the mailbox that sends the notice of each form message.
  • Google: the firm's e-mail and, with your authorization, access statistics and advertising measurement. The map on the contact page is loaded from Google Maps.
  • Trustindex: displays on the site the firm's public Google reviews.
  • Brevo: sending of the newsletter by e-mail and record of who asked to receive it or unsubscribed.
  • Meta (WhatsApp): when you choose to contact us by WhatsApp, the conversation is also subject to WhatsApp's own privacy rules.

Data may also be disclosed to authorities when the law or a court order requires it.

Some of these providers may store data on servers outside Brazil. In those cases, the transfer follows the safeguards provided for in the General Data Protection Law.

How long the data is kept

  • Site access records: 6 months, the period set by the Marco Civil da Internet.
  • Access statistics: up to 14 months, the period configured in the tool.
  • Contact that did not become an engagement: up to 6 months after the last message. After that, the conversation is deleted.
  • Newsletter: for as long as you want to receive it. When you unsubscribe, the e-mail leaves the mailing list and only the record of the unsubscription remains, so that you do not receive it again.
  • Clients: for the duration of the contract and, afterwards, for the legal periods, including for the defense of the firm and of the client in proceedings.

Cookies

Cookies are small files that the site stores in your browser.

  • Essential: make the site work and remember your choice in the cookie notice. They do not depend on authorization.
  • Statistics: measure the use of the site in aggregate (Google Analytics). They are activated only if you authorize them.
  • Advertising measurement: record whether a visit coming from a Google ad ended in contact (Google Ads). They are activated only if you authorize them.

You can change your choice at any time through the "Cookie preferences" link in the footer (shown in Portuguese as "Preferências de cookies"), and you can also delete or block cookies in your browser settings.

Your rights

At any time, you may ask for:

  • confirmation that we process your data and access to it;
  • correction of incomplete, inaccurate or outdated data;
  • anonymization, blocking or deletion of unnecessary or excessive data, or data processed in breach of the law;
  • portability of the data to another provider;
  • deletion of data processed on the basis of your consent;
  • information about who we share your data with;
  • information about the possibility of not giving consent and what happens in that case;
  • withdrawal of consent.

To do so, write to the data protection officer at dados@caldonazo.com. We reply within 15 days. If any data must be kept because of a legal obligation or for the defense of rights, we explain the reason in our reply.

You may also lodge a complaint with the Brazilian National Data Protection Authority (ANPD).

Security

The site uses an encrypted connection (HTTPS). Access to the data is restricted to the people at the firm who need it to assist you, with individual passwords. If a security incident occurs that may cause relevant risk or harm, you and the ANPD will be notified, as the law requires.

Children and adolescents

The site is aimed at adults. Data of children and adolescents is processed only when a parent or legal guardian contacts us to defend a right of theirs, such as in custody, visitation, child support and parental alienation matters, always in the best interest of the child or adolescent.

Changes to this policy

This policy may be updated to follow changes in the law or on the site. The version in force is always on this page, with the date of the last update.
